  • I am having glitches within the app. How can I fix this?
    We would love to hear about any issues that are happening in the app so that we can better improve our services! 💜 If these problems have persisted after refreshing the app, then please contact us at support@withtheband.co.
  • Who do I contact if my account is not reflecting posts/edits/comments I have made?
    First we recommend closing out of the app all together to see if refreshing it could fix this issue. If the issue persists, please contact support@withtheband.co.
  • I was unable to join the livestream because of a troubleshooting problem. Who can I contact?
    For all issues involving troubleshooting, please contact support@withtheband.co.
  • A video on my feed will not play. Who can I contact?
    If this issue persists after refreshing the app, then please contact support@withtheband.co.
  • Is my device supported by With the Band?
    With the Band works on all web browsers. The With the Band app works on all Android and Apple Devices. 🎉
  • How do I update the app?
    The app store will notify you when an update is available. Go into the available updates on your device, and choose With the Band. When that update shows as complete, the app altogether should be updated! Not all updates will be visibly noticeable. Some updates will fix bugs, software errors, or other functionality issues. 😁
  • Why is the website loading so slowly?
    First, ensure that you have a stable internet connection. Then try to close and reload your browser. If the website is still running slowly, we may be making improvements on the back end. We are continuously working to update the app and website to ensure that you get the best experience out of using our platform! ✨If this issue persists, contact us at support@withtheband.co.
  • Can I connect to my With the Band account while abroad?
    Yes! 🌎
  • Is With the Band currently available in other languages?
    Unfortunately, no. With the Band is currently only available in English.

  • How do I change my billing address?
    1. In the top right hand corner, you'll see your profile picture. Hover over that, and in the drop down that appears, select "Account Settings." 2. On this page in the top right hand corner of the white section with your profile information, there will be a button that says “Edit.” 3. On the right hand side of this window it will have a section labeled “Address.” 4. Fill out the new information for your address that you wish to have on file, and then at the bottom of this window click “Save Changes.”
  • How do I update my credit card information?
    1. In the top right hand corner, you'll see your profile picture. Hover over that, and in the drop down that appears, select "Account Settings." 2. On this page, scroll down to see “Billing.” 3. On the right side, click on “Add/Update Card.” 4. A popup window will allow you to update this information, and then at the bottom of that window, click “Update Card.”
  • How do I get a refund for my subscription?
    With the Band does not offer subscription refunds. If you wish to cancel your subscription, you can do that by unsubscribing from all the Fan Crews that you are a part of. This will ensure that at the end of the billing cycle, your card will not be charged again. If the subscription is yearly, you will still have access to the Fan Crew until one year from your last payment.
  • Who can I contact about a billing issue?

  • Is there a free trial?
    With the Band does not offer a free trial.
  • Are any discounts offered based on education, profession, or military service?"
    At this time, we are unable to offer any discounts.
  • If I delete the app, will I stop being charged?"
    If you have not actually unsubscribed from each Fan Crew that you are in, then you will keep being charged.
  • If I delete my account, when will I stop being charged?"
    To delete your account, you must first unsubscribe from all of your Fan Crews. Once that has been done, you will stop being charged at the end of the billing cycle.
  • What is a Fan Crew?
    A Fan Crew is With the Band's modern day version of a fan club. By joining a Fan Crew, you will have access to exclusive artist content. Your selected artist gets to choose what content they offer their fans! 💜
  • How do I join a Fan Crew?
    To join a Fan Crew, visit (https://app.withtheband.co/explore). Choose which Fan Crew you want to join. From there you will be directed to create an account. Input your personal information and your billing information, and then you are With the Band! 🥁🎉
  • How can I find other Fan Crews that I might be interested in?
    Visit our Fan Crew homepage (https://app.withtheband.co/explore) to see all artists that are a part of With the Band. Here you can go and view each artist’s Fan Crew page. 👀
  • Why are there different tiers for some Fan Crews and not for others?
    The tiers are based exclusively on what the artist wants to provide their fans! With the Band works with each artist to ensure that their Fan Crew is at its full potential! That looks different for each artist we work with. Because of this, some artists are going to have tiers and some may choose to not have tiers!
  • Do I have to create a new account for each Fan Crew I join?
    No. When you choose to join a new Fan Crew, your information is already stored! Simply choose which tier you want to be in, and your account and credit card that is on file will be charged.
  • How do I comment?
    Under each post, there is a text box that says, "Comment." Click in the box to type what you want to say, and hit enter when you are done. This will post the comment, and it will stay underneath that one post. If you come back later and don't see your comment, it may be hidden in the "Older Comments." Click that drop down to see all comments.
  • How do I edit or remove a comment?
    Once you have commented on a post, to the right of your comment (on the same line) there will be an edit button and a trash button. When you click on the edit button, the comment you previously posted will appear once again in a text box. Here you can make your edits, and then hit enter to save the new changes to your comment. If you hit the trash button, your comment will be deleted.
  • How do I like a post?
    At the bottom right hand corner of each post, there is a button with "+" on it. Click on this button and a series of emojis will appear. You can then choose which emoji best represents your reaction to the post! Another way to like a post is to click on the emojis that other people have chosen. For example, if one fan has already reacted with a smiley face emoji, you can click on that icon, and it will save that emoji as your reaction as well.
  • How do I interact with other fans?
    The best way to interact with other fans is by commenting and posting in the different channels! Artists create channels to allow fans to share their own thoughts about photoshoots, tour dates, etc. Think of this as the best group text EVER! ✨
  • How do I maintain and make edits to my account?
    1. In the top right hand corner of the Fan Crew page [link out], your profile picture should appear. By hovering over that, a drop down should show. 2. Click on "Account Settings." 3. In the top right hand corner, there is an “Edit” button. Here you can make edits to your profile like changing your name, picture, shipping information, email, and password. 🤗
  • Where do I edit my profile?

  • How do I change my email?
    1. In the top right hand corner, you'll see your profile picture. Hover over that, and in the drop down that appears, select "Account Settings." 2. On this page in the top right hand corner of the white section with your profile information, there will be a button that says “Edit.” 3. A window will appear, and on the far right it will show a text box with your current email address listed. 4. To change that email, just type in the new one, and click “Save Changes” at the bottom of this window.
  • Can I change my username name?
    Yes! 😊 1. In the top right hand corner, you'll see your profile picture. Hover over that, and in the drop down that appears, select "Account Settings." 2. On this page in the top right hand corner of the white section with your profile information, there will be a button that says “Edit.” 3. A window will appear with your account information on it. 4. On the left next to your profile picture, there is a text box with your current username in it. 5. To change your username, simply type in the new one you wish to have, and then click “Save Changes” at the bottom of this window.
  • How do I unsubscribe?
    You need to unsubscribe from all the Fan Crews that you are a part of. 1. To do this, login to your account. 2. Your profile picture will be in the top right corner. Hover over that and a drop down with "Account Settings" will appear. Click on "Account Settings." 3. This will take you to an overview of what Fan Crews you are in. Underneath each Fan Crew, there is a button that says "Cancel Subscription." 4. By clicking that button you will no longer be a part of that Fan Crew. Once you have unsubscribed to all Fan Crews that you are a part of, your card will stop being charged at the end of the billing cycle. We’ll be sad to see you go! 😢💔
  • How do I delete my account?
    If you want your account to be deleted, first you must unsubscribe to all the Fan Crews that you are a member of. At this point your card will no longer be charged, and you will no longer have access to exclusive content at the end of that billing cycle. After this, if you want your account to be entirely deleted, please email us at support@withtheband.co.
  • If I am gifted or win a free membership, how do I extend my account after this is over?"
    Your account will automatically be extended, and the credit card you provided when first creating your account will start being charged.
  • If I am gifted or win a free membership and choose not to extend my account, will that account automatically be deleted?"
    No. In order to actually cancel your account, you would need to go into your account settings. unsubscribe from the Fan Crews that you are currently a part of. 1. To do this, login to your account. 2. Your profile picture will be in the top right corner. Hover over that and a drop down with "Account Settings" will appear. Click on "Account Settings." 3. This will take you to an overview of what Fan Crews you are in. Underneath each Fan Crew, there is a button that says "Cancel Subscription." 4. By clicking that button you will no longer be a part of that Fan Crew. As long as this is done prior to your first billing cycle after your gift membership expires, your card will not be charged. We’ll be sad to see you go! 😢💔
  • I accidently posted content that violates the Terms and Conditions of With the Band. Will my account be terminated?
    As owner of your account, it’s entirely your responsibility to ensure that anything shared on your account abides by the With the Band Terms and Conditions and Community Guidelines. (link) If you are unsure of a link, photo, video, or other content on your account breaks these, we suggest that you reference our Community Guidelines before sharing it. Content that breaks Terms of Conditions or Community Guidelines, whether shown accidentally or on purpose, can be reported and moderation may take appropriate action on that content, including removing the content and issuing a suspension on your account. Examples of this would include graphic nudity, harassment, physical threats, etc.
  • Do I need to be a target of hateful content in order to report it?
    No. With the Band promotes inclusivity within our community. If you see something being posted that is not following our Community Guidelines or our Terms and Conditions, please reach out to us at support@withtheband.co.
  • Can I share exclusive content?
    No. With the Band is designed for fans to have a way to engage with their favorite artists on a more personal level. Some content shared within the app will be exclusive content that cannot be found elsewhere. If this content is shared on another platform, it will be reported and removed. If this content is shared from a user of the With the Band platform, their account will go under review for suspension or potential termination.
  • What if I end up not being able to come to my scheduled virtual meet and greet?
    Please contact us if you are not able to be at your scheduled meet and greet. Meet and Greet packages will vary from artist to artist.
  • How do I report a comment for violating With the Band’s Community Guidelines?
    Within the app, next to each comment there are three dots. Click on those dots, and a pop up will appear saying, “Flag as Inappropriate.” By clicking this, that comment will be removed from your feed, and With the Band will be notified.
  • How do I flag an account?
    Go to the user’s profile that you wish to flag. Once on their profile, click on the three dots in the top right corner. A pop-up will ask if you wish to “Block and Report Abuse.” By clicking that, you will no longer see any content from that user, and With the Band will be notified.
  • Terms and Conditions
    With the Band Conditions and Terms of Use This Agreement is placed in effect as of December 1, 2020 (the “Effective Date”). 1. Introduction 1.1 This Agreement Thank you for using With the Band, an electronic platform designed, among other things, to bring dedicated music fans together with their favorite artists as well as other businesses and business models we may enter into from time to time. The terms “With the Band,”, “we,” “us,” and “our,” include With the Band, LLC and our affiliates. Our “Platform” includes any website, application, or service we offer, including content we offer and electronic communications we send. We use the terms “you” and “your” to mean any person using our Platform. We provide our Platform to you subject to these Terms and Conditions. This agreement includes our Terms and Conditions of Use, our Privacy Policy, and agreements pertaining to payment amounts or other services (all the foregoing collectively the “Agreement”). We will maintain an up-to-date version of them on our website and on any mobile versions. By creating a user account on our Platform, or otherwise making use of any service we provide online or through our mobile application(s), you agree that you have read and understand the Terms and Conditions of the Agreement, and agree to enter into and be bound by the Agreementand If you do not or are unable to agree to the Agreement, you are neither granted permission nor authorized to use our Platform. 1.2 Revisions to This Agreement We may modify the Agreement from time to time at our sole discretion with or without notice. When we do, we will provide notice to you by publishing the most current version and revising the date at the top of this page. If we make any material change to this Agreement, we may provide additional notice to you such as sending to you an email or displaying a prominent notice on our Platform. By continuing to use the Platform after any changes come into effect, you agree to and are bound by the revised Agreement. Thus, please make sure you read any notice of change carefully to fully understand the changes to the Agreement. 2. Your Account and Membership 2.1 Eligibility In order to use With the Band or any and all of its affiliated services, you must be: (A) eighteen (18) years of age or older or be thirteen (13) years of age or older and have the written consent of at least one parent or legal guardian; (B) have the power and ability to enter into a binding contract with us and are not prohibited from doing so under any and all applicable laws; and (C) are a resident of a country where With the Band and its collective services are available. 2.2 Account Information and Security When you register, you provide us with basic information, including an email address and a password. Keep your email address, password, other account information current, accurate, and private. You alone are responsible for anything that happens as a result of your failure to maintain the security and confidentiality of your login credentials. If an unauthorized party is using your login credentials, notify us immediately. 2.3 Suspension of Your Account We may modify, suspend, or terminate your account or access to the Platform if, in our sole discretion with or without prior notice, we determine that you have violated the Agreement, including any of the policies or guidelines that are a part of this Agreement or otherwise may be enacted by us, that it is in the best interest of the With the Band community, or to protect our brand, intellectual property, or Platform. We also may remove accounts of members who are inactive for an extended period of time without prior notice. 3. Costs for Our Services 3.1 Annual Membership Fee With the Band charges a fee for its services, which is collected from you on an annual basis. Unless you opt out, this annual fee with be charged automatically from whichever method of payment is stored on our Platform. 3.2 Other Fees and Associated Costs We may, in the future, implement a new fee, or modify an existing fee, for certain current or future features of our Platform. If we do implement a new or modified fee, we will give you advanced notice by posting changes on our Planform or sending you an email. You agree to pay those fees and any associated taxes for your continued use of our Platform. Unless otherwise stated, all fees and all transactions are in U.S. dollars. All fees are exclusive of applicable federal, state, local, or other taxes. 4. User Content and Guidelines 4.1 User Content You are solely responsible for your Content. For purpose of the Agrement, the word “Content” means any information, material, photographs, images, or other content posted to our Platform or otherwise provided to us. This Content includes, but is not limited to information posted on our Platform relating to fan meet ups with artists and fan projects. You agree that you and your Content shall not violate the rights of any third-party (such as copyrights, trademarks, contract rights, privacy rights, or publicity rights), or this Agreement. We do not claim ownership of your Content. However, to enable us to operate, improve, promote, and protect With the Band and our Platform, and to ensure we do not violate any rights you may have in your Content, you hereby grant With the Band a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable, transferable right and license (including a waiver of any moral rights) to use, host, store, reproduce, modify, publish, publicly display, publicly perform, distribute, and create derivative works of, your Content and to commercialize and exploit the copyright, trademark, publicity, and database rights you have in your Content. 4.2 User Guidelines We at With the Band have set some standards and rules for you to follow whenever you use our Platform to ensure that our Platform remains enjoyable for all. When using our Platform, follow these rules and when possible, encourage others to do the same. The following acts are not permissible for any reason at any time: Giving your password to another With the Band user or non-With the Band user, or using any other user’s username (or Login ID) and password; Imitating, acting, or pretending to be a different person than who you really are on our Platform, which includes but is not limited to age, gender (the gender you currently identify with), or other identifying physical features; Using any and all automated means to reap information from With the Band (including but not limited to bots, scrapers, and spiders); Selling any With the Band account to a third-party, or otherwise receiving compensation, financial or otherwise, with the purpose of influencing the name of a With the Band account or the content included on such account, unless otherwise permitted under this Agreement; Depicting, glamourizing, depicting, or encouraging illegal drugs, drug use, and/or paraphernalia; Sexualized communications with between users under the age of eighteen (18) years old; or Instigating, enflaming, glamorizing, encouraging, and/or planning any act of violence, insurrection, and/or domestic or foreign terrorism. We ask that you respect With the Band and all other persons who use our Platform. Do not partake in any activity, post any contact information, or apply for and/or use a username, which itself is or includes material that: Is offensive, abusive, defamatory, threatening, pornographic, or obscene; Is illegal, or is intended to commit or promote the doing of an illegal act of any kind, including though not limited to violations of intellectual property rights, privacy rights, publicity rights, or proprietary rights of With the Band or any third-party; Includes either your or another person’s user password intentionally or intentionally includes personal data of third-parties or is done to gain knowledge of such personal data; Includes malicious technological content like malware, viruses, Trojan horses, or otherwise interferes with or infects any other person’s technological devices; Is done with the purpose of harassing or bullying any other person, or does in fact bully another person; Misrepresents your relationship or affiliation with another person, impersonates another person or group/entity, or is in any way fraudulent, deceitful, false, or misleading, whether for commercial or noncommercial purposes; Involves commercial activity such as advertisements, promotions, contests, sweepstakes, or other schemes (whether legal or illegal under applicable law) that are not expressly consented to by With the Band; or Conflicts with the Agreement in any way, as viewed under the sole discretion of With the Band. You have been made aware of the fact that, and acknowledge and agree that posting Content which meets any of the above criteria can likely result in the immediate termination or suspension of your account on With the Band without prior notice. You also acknowledge and agree that With the Band maintains the right to reclaim your username at any time and for any reason, as judged by the sole discretion of With the Band. 4.3 Users Interactions with Others With the Band does not control the Content of other members. When we become aware of impermissible and/or inappropriate Content on our Platform, we reserve the right to investigate and take appropriate action to be determined at our sole discretion, but we do not have any obligation to monitor, nor do we take responsibility for the Content of any members. With the Band is not a party to any offline arrangements made through our Platform. With the Band does not attempt to verify the truth or accuracy of statements made by users and makes no representations or warranties concerning the conduct or Content of any users or their interactions with you. Any Content on the Platform should not be considered a news source and should not be relied upon in making any decisions or developing any opinions on any scientific, political, or other issue. 5. Warranties and Limitation of Liability 5.1 Disclaimer of Warranties Although With the Band does make reasonable efforts to give our users the best possible service, it is hereby understood that our services are provided “as is” and as they are available. Therefore, you agree and understand that the services provided by With the Band are provided as such and that we do not give an express or implied warranty, promise, or guarantee of any kind regarding any of the services we provide or the availability and lack of disruption in services. Thus, your use thereof is done at your own risk. To the greatest extent allowed under applicable law, With the Band makes no promises or guarantees and disclaims any warranty or conditions pertaining to the satisfactory quality of any of our services, or their fitness for any particular purpose, merchantability, or non-infringement. With the Band does not guarantee that its services are free of any and all malware or anything other harmful viruses or components. Furthermore, With the Band does not guarantee, support, warrant, or assume responsibility for any and all third-party applications (or content thereby generated) accessible via our Platform, or any other product or service offered or advertised by any and all third-parties on or via With the Band’s services or any hyperlinked website, or featured in any advertisement or banner. 5.2 Limitation of Liability TO THE GREATEST POSSIBLE EXTENT PERMITTED BY APPLICABLE LAW, IN NO CASE OR EVENT WILL WITH THE BAND AND, ITS OFFICERS, DIRECTORS, MEMBERS, SHAREHOLDERS, AGENTS, EMPLOYEES, CONSULTANTS, BOARD, BOARD MEMBERS, INVESTORS, AFFILIATES, SUBSIDIARIES, SPONSORS, ASSIGNS, SUPPLIERS, LICENSORS, AFFILIATED ARTISTS, AND ANY OTHER THIRD-PARTY PARTNERS (REFERRED TO HEREAFTER AS “WITH THE BAND PARTIES”) BE HELD LIABLE FOR ANY SPECIAL, INDIRECT, PUNITIVE, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF ANY WITH THE BAND PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) ARISING OUT OF OR IN CONNECTION WITH: (A) OUR PLATFORM, OR THIS AGREEMENT, OR THE INABILITY TO USE OUR PLATFORM (HOWEVER ARISING, INCLUDING OUR NEGLIGENCE); (B) STATEMENTS OR CONDUCT OF OR TRANSACTIONS WITH ANY MEMBER OR THIRD-PARTY ON THE PLATFORM; (C) YOUR USE OF OUR PLATFORM OR TRANSPORTATION TO OR FROM WITH THE BAND FAN MEET UPS OR THE ACTIONS OF YOU AND OR OTHERS AT WITH THE BAND FAN MEET UPS OR FAN PROJECTS; (D) ANY AVAILABILITY OR DISRUPTION OF SERVICES; (E) ANY OTHER MATTER RELATING TO THE PLATFORM; OR (F) FORCE OF NATURE, NATURAL DISASTER, ARTIFICIAL DISASTER, VIRUS-SPREAD, PANDEMIC, CIVIL DISRUPTION, RIOTS, OR WAR. THE MAXIMUM AGGREGATE LIABILITY, IF ANY, OF WITH THE BAND PARTIES TO YOU FOR ANY REASON AND UPON ANY CAUSE OF ACTION ARISING OUT OF OR RELATING TO THIS AGREEMENT, THE PLATFORM, AND ANY SERVICES AND/OR PRODUCTS OFFERED BY WITH THE BAND PARTIES SHALL BE LIMITED TO DIRECT DAMAGES IN AN AMOUNT NOT TO EXCEED THE TOTAL AMOUNT OF THE COMPENSATION PAYABLE AND ACTUALLY PAID UNDER THIS AGREEMENT (AS THE SAME MAY BE ADJUSTED FROM TIME TO TIME PURSUANT TO THE TERMS OF THIS AGREEMENT). THE FOREGOING LIMITATIONS SHALL APPLY REGARDLESS OF THE CAUSE OR FORM OF ACTION, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY OR OTHERWISE. The foregoing paragraphs, which explicitly limit liability for With the Band Parties applies with equal force to all artists and their representatives/affiliates whom collaborate in any way with With the Band (“Affiliated Artists”). Affiliated Artists are in no way responsible for any event, transaction, interaction (directly, indirectly, virtually, or in-person), or occurrence arising out of or relating to any With the Band fan meet up or fan project. There are some aspects of this Section that may not apply in certain jurisdictions if they are prohibited under applicable law. Unless otherwise prohibited, all aspects shall apply. 6. Release and Indemnification 6.1Release of Liability You agree to release With the Band Parties, Affiliated Artists, and any other third-party partners from claims, demand, and damages of every kind and nature, known and unknown, now and in the future (referred to hereafter as “Claims”), arising out of or in any way connected with any transaction with a third-party, your interactions with other members, or in connection with a With the Band event. You also agree to release organizers from Claims based on an organizer’s negligence arising out of or in any way connected with their content or a With the Band event. Further, you waive any and all rights and benefits otherwise conferred by any statutory or non-statutory law of any jurisdiction that would purport to limit the scope of a release or waiver to the fullest extent permitted by law. 6.2 Agreement to Indemnify To the greatest extent permissible under applicable law, you agree to indemnify all With the Band Parties and hold any With the Band Parties completely blameless and harmless from and against any and all damages, losses, and/or expenses of any kind (including but not limited to reasonable attorney’s fees and related costs) which arise out of: (A) a breach of the Agreement which you commit; (B) any user content on With the Band; and (C) any violation which you commit of any law or the rights of any third-party. 7. Dispute Resolution 7.1 Governing Law Unless prohibited by mandatory law in a member state of the European Union or any other jurisdiction, the Agreement (and any noncontractual disagreements or any claims due to or related to them) is subject to the laws of the State of Tennessee in the United States of America, without regard to any choice of law provisions of any other state or country. 7.2 Disputes; Arbitration Unless otherwise prohibited by law, if a dispute should arise between you and With the Band, we will attempt to resolve the dispute discussion if possible. If unsuccessful in doing so, then you agree that any dispute with With the Band in any way and any type, or any dispute regarding With the Band Parties in relation to With the Band’s Platform, services, products, and the Agreement, you agree to settle any dispute by prompt, confidential, and binding arbitration pursuant to the Commercial Dispute Resolution Process and the Supplementary Procedures for Consumer Related Disputes of the American Arbitration Association (“AAA”) and then in effect (“the AAA rules”) using a single arbitrator. The arbitration shall occur in Nashville, Davidson County, Tennessee, and shall the governing law set forth in Section 7.1 above. If With the Band or With the Band Parties prevail, you shall be required to pay attorneys’ fees, expenses, filing fees, arbitration fees, and cost incurred therein. The arbitration shall be conducted in the English language and any party who does not speak the English language will be solely responsible for any translations and/or translators so as to comply with this requirement. The arbitration shall be the sole and exclusive means for resolving disputes related to the Agreement, With the Band in any way and any type, or any dispute regarding With the Band Parties in relation to With the Band’s Platform, services, products, and the Agreement.. Any and all arbitrations must be started by filing a demand for arbitration within the time frame of three (3) months after the date the party of the plaintiff/claimant asserting the claim first knows or reasonably should have known of the act, omission, or default which game rise to the claim itself; and there will be no right to remedy any claim that is not made within the time frame agreed upon in this section. If, under applicable law, the one year time frame is not permissible, then any claim must be asserted and filed within the shortest time period allowed under the applicable law. 7.3 Arbitration Enforcement Enforcement the arbitration provisions herein and enforcement of any judgment, determination, and/or awards from the arbitration shall solely and exclusively be made in the state or federal courts for Davidson County, Tennessee USA and, unless otherwise prohibited by law, you hereby waive any and all objections and defenses of lack of personal jurisdiction, improper venue, inconvenient venue, and lack of subject-matter jurisdiction.. 7. 4 Jury Waiver EACH PARTY HEREBY IRREVOCABLY WAIVES ITS RIGHTS TO A JURY TRIAL OF ANY CLAIM OR CAUSE OF ACTION BASED UPON OR ARISING OUT OF THIS AGREEMENT,THE SUBJECT-MATTER OF THIS AGREEMENT, OR ANY . Miscellaneous 8.1 The Agreement Aside from anything stated to the contrary in this Section, or explicitly agreed upon in writing between you and With the Band, the Agreement constitutes all the conditions and terms that you and With the Band have agreed upon, and supersedes any prior agreements made pertaining to the subject-matter of the Agreement, whether oral or written. 8.2 Severability and Waiver Unless otherwise stated in the agreement, the invalidity of any specific section of the agreement for any reason or to any extent is not to be understood as voiding any or all remaining valid sections of the agreement, nor shall the validity or enforceability of any and all valid sections be lessened by the invalidity of one specific section or subsection, or stipulation therein. Failure by With the Band to enforce the Agreement, or any stipulation held therein, shall not waive With the Band’s rights or the rights any With the Band third-party beneficiary’s right to do so presently or in the future. . If any provision of the Agreement is held in whole or in part to be unenforceable for any reason, the remainder of that provision and of the entire Agreement will be severable and remain in effect. Paragraph headings are for organization only and shall not impact the Terms and Conditions in the Agreement 8.3 Assignment With the Band maintains the right to assign the Agreement or any part found therein.     With the Band's Community Guidelines With the Band is a platform designed to create community between fans and artists alike. We promote inclusivity and connection, and we encourage you to help us in allowing this community to flourish. This platform is a safe place for everyone, and in order to attain that, we must all be kind, inviting, and honest. Do not post comments that are hateful. Do not steal content. Do not post anything that violates With the Band’s Terms and Conditions. If you see something that is counter to our inclusive culture, please report it immediately. With the Band is a community created for all fans. We want to make sure that fans of all artists are welcome and feel at home in our platform. We work hard to ensure that fans have the best experience they can while using our platform, but part of that responsibility falls on the users of our platform as well. By joining With the Band, you have already agreed to our Terms and Conditions, but our Community Guidelines are here to help you better understand how you can help us foster a welcoming fan community. If someone is overstepping the boundaries that we have set for a safe and inclusive environment, their account may be reviewed for suspension or potential termination. We will try our best to be understanding, but ultimately, if we feel that someone is causing the platform to be unsafe for others, we have the right to temporarily or permanently remove them. Here are some basic rules to stand by when in the With the Band platform: Fan Interactions: Strive to make every connection valuable. Make sure interactions between other users and yourself are genuine. We encourage you to promote fan events that you have created, but please help us maintain a spam-free environment. Do not offer money to other fans in exchange for exclusive content that was unavailable to you. There will be other opportunities. If you have purchased a Meet & Greet, do not post that you are selling it. When you have purchased a Meet & Greet, it is non-transferable. If we come across this happening, your account will be reviewed as this is considered a form of scamming. You are allowed to have a username that does not include your actual name. However, this comes with the responsibility of knowing that you should never impersonate someone. If we find that you are impersonating someone, With the Band has the right to potentially terminate your account. We do not tolerate the misleading of others, as this is also considered another form of scamming. With the Band does not tolerate hateful language or behavior. If we are alerted to any misconduct that is rooted in hate, we will immediately suspend the account while we further investigate. Any account that makes direct threats of physical harm will immediately have their account suspended indefinitely. If With the Band feels that someone has become a danger to themselves or to the community, further actions may be taken to ensure the safety of each individual. If an account has been warned before about hateful behavior and still continues to behave this way, their account will be terminated indefinitely. We encourage fans to report this kind of behavior. If you see something, say something. This includes fan-to-fan and fan-to-artist interactions. If a user is shown to be spewing hateful language and/or harassing an artist, their account may face removal from that Fan Crew, overall suspension, or overall termination. If this behavior happens while in a virtual meet and greet, the artist has the right to immediately terminate the session, and the individual responsible will not be reimbursed. With the Band will further investigate to determine if the account faces removal from that Fan Crew, overall suspension, or overall termination from the With the Band platform. Content: By posting on our platform, you are acknowledging that you have ownership of that material. If any copyright or trademark issues arise, the material will be flagged and removed. If this continues to be an issue with an account, that account will be reviewed and could face termination. Follow the law. If any content is posted that is not law abiding, it will be flagged, removed, and the account will face termination. With the Band may take further action against an offense of this nature. We take these matters extremely seriously. If accusations are made that are entirely false, the person making these claims may also face removal from the platform. When posting news-worthy events, please be sensitive to how others may be feeling. Especially in the music world, it is important to remember that artists we love and look up to are people too. They all have things they are going through and dealing with, and With the Band wants to create a welcoming platform for artists as well as fans. If something is a sensitive subject that could be hurting someone, don’t post it. If you are unsure, take time to think about how you might feel on the other side of such news. With the Band does not condone the glorification of self-injury or mental or physical illnesses. We understand that a community can be needed to share these struggles with, and we hope that With the Band becomes a second home to fans. However, any jokes or inappropriate references to such struggles will be considered a form of hateful speech. These comments will be removed, and the account will be under review. Such dissemination of data is necessary for the Affiliated Artists and their management teams to ensure the Affiliated Artist will be available for fan meet ups, fan projects, and virtual fan interactions. The Affiliated Artist’s management teams need data like email addresses and name to contact With the Band users about potential meet ups and may require data like postal addresses to determine where, geographically such a meet up should occur. 4.3 Advertisers and Other Third Parties Users’ names and email address will not be given to advertisers. However, users’ postal codes and favorite artists may be sold to advertisers or other third parties. Advertisers use this data to potentially target the users with advertisements relating to their favorite artists and to find geographic trends. If you do not want us to use your data in this way, or to pass your details on to third parties for marketing purposes, simply log in to your account and click the appropriate “opt-out” box available in your user dashboard to disable the information type you no longer wish to receive. Storage of Information 5.1 How We Store Your Information All the information you provide may be stored on our servers (including cloud-based server technology), or transferred or accessed by entities around the world as described in this policy, including but not limited to any With the Band company or affiliate, using commercially reasonable standards and precautions.
